Sometimes you can beat the Internal Revenue Service, and make it pay for bothering you.
In two recent cases, the U.S. Tax Court has ordered the IRS to pay the litigation costs of taxpayers who fought IRS demands for more taxes. In court, the taxpayers proved that the IRS had been wrong - and unreasonable - all along.
By law, a taxpayer is entitled to reimbursement for his expenses if, after exhausting his appeals within the IRS, he goes to court, substantially prevails on the tax issues and demonstrates that the IRS has persisted in unreasonable positions after litigation began.
